GUIALTO is a simplified joint-stock company (SAS) with a share capital of €8,000.00. Its registered office is located at 488 rue du Pays d'Orthe, 40230 Saint Geours de Maremne, registered with the Trade and Companies Register of Dax under number 501 386 262 R.C.S. Dax and with VAT number FR71501386262.

These general terms and conditions of sale apply to all sales made through the website www.guialto.com.

Article 1: Purpose

Any order placed on the website www.guialto.com implies the buyer's full and unreserved acceptance of these general terms and conditions of sale.

Only specific provisions issued in writing by our company and included in the order confirmation may override these terms. The customer explicitly agrees to our general terms and conditions and waives their own terms or any other documents they may issue. Our agents or representatives are not authorized to enter into contracts on behalf of our company. Orders taken by them are only binding if confirmed in writing. GUIALTO reserves the right to modify these terms and conditions at any time. The applicable terms are those in force on the date of the order.

Article 2: Information on the website and in our catalogs

We present in our catalogs, product lists, brochures, and on our website products whose features may change. In the event of a change, GUIALTO commits to delivering a product that matches, based on its initial description, the expected qualities.

The features of the products offered for sale are presented on product sheets. Photos and descriptions are not contractually binding. GUIALTO cannot be held responsible for any errors. All text and images on the GUIALTO website are protected worldwide under copyright and intellectual property rights; reproduction, even partial, is strictly prohibited.

If an ordered product becomes unavailable, the customer will be notified by email or postal mail as soon as possible.

Prices are indicated in euros, excluding shipping costs. VAT and shipping fees are shown once the customer selects a product and completes their selection. GUIALTO reserves the right to modify prices at any time, but products will be billed at the rate in effect at the time the order is placed.

Article 3: Seller’s Contract Terms – Order Confirmation

Clicking on “Confirm your order” validates the customer’s order, and an order summary appears once the sales terms are accepted. Before this validation, the customer is offered the opportunity to review and correct their order details. Any order validated by the customer constitutes an irrevocable acceptance of the sales contract, which can only be contested under the terms defined herein for “right of withdrawal” and “out of stock.”

GUIALTO confirms the order by email to the address provided by the buyer, including all order details.

Data recorded by GUIALTO constitutes proof of the nature, content, and date of the order. This data is archived under legal conditions and timeframes.

GUIALTO reserves the right to cancel any order from a customer involved in a payment dispute.

Article 4: Delivery Time and Shipping of Goods

Products are delivered in mainland France after the order is received and fully paid, to the address provided by the buyer.

GUIALTO is not liable for delivery failures due to the buyer or resulting from unforeseeable and unavoidable events caused by third parties or force majeure.

Article 5: Receipt, Reservations, and Return of Goods

The customer is responsible for checking the condition of packages and goods upon delivery and for noting any reservations on the delivery receipt. If the delivery requires reservations, the buyer must inform GUIALTO in writing or by email within 48 hours, excluding public holidays.

If transport damage is detected, the customer must refuse the damaged item and mark “Refused due to damage” on the delivery note. Failure to do so may prevent any claim.

Article 6: Right of Withdrawal

The right of withdrawal applies to any individual buyer acquiring goods not intended primarily for professional use.

The consumer has 14 days to exercise this right without providing a reason.
This 14-day period starts upon receipt of the goods by the consumer or a third party (excluding the carrier) designated by the consumer.
The buyer must notify GUIALTO of their withdrawal decision before the end of this period using the available withdrawal form.

Return shipping costs are fully borne by the customer and are the customer’s responsibility in case of theft, loss, or damage. The customer is free to choose the return method and service provider, but bears full responsibility for it.

In general, returned products must be in resellable condition for GUIALTO to accept them.

The right of withdrawal does not apply to unsealed goods.

GUIALTO will refund the full amount paid, including delivery fees, within 14 days after receiving the returned goods or upon receiving proof of shipment. Refunds are made using the same payment method as the original transaction.

Article 7: Retention of Ownership

All products sold remain the property of GUIALTO until full payment is received. However, risk passes to the buyer upon delivery. GUIALTO may invoke this ownership clause eight days after sending a formal payment notice by registered mail with acknowledgment of receipt, if unpaid. Products must be returned immediately at the customer’s expense and risk upon request.

Article 8: Payment Terms

The price charged to the customer is the one stated in the order confirmation from GUIALTO.
All orders imply a payment obligation by the buyer.
Payments can be made via:

  • Online credit card (Carte Bleue, VISA, Mastercard),
  • Bank transfer,
  • Check

The order is only considered effective once payment is received by GUIALTO.
GUIALTO reserves the right to refuse orders from customers with unresolved disputes.
Bank card information is transmitted securely.

Article 9: Warranties

In addition to the legal warranty of conformity and warranty against hidden defects, certain products may benefit from a specific commercial warranty.

This warranty does not cover:

  • Replacement of consumable items,
  • Improper, irregular, or abnormal use of products,
  • Defects or characteristics mentioned in product sheets,
  • Damage caused by improper use of the product.

The client must return the faulty product(s) directly to the supplier only after GUIALTO’s approval via email or phone.
Return instructions will be sent via email by GUIALTO.
Under this commercial warranty, all return shipping costs are the client’s responsibility.
Incomplete or partial returns will not be covered.
Any trace of modification or disassembly voids the warranty.

Article 10: Dispute Resolution

These General Terms and Conditions and the relationship between the buyer and GUIALTO are governed by French law.

In the event of a dispute, the buyer may resort to conventional mediation or any other alternative dispute resolution method.
If the product is purchased as part of a business activity, the Commercial Court of NICE shall have exclusive jurisdiction, even in summary proceedings or in the case of multiple defendants.
